Conditions of use
As a condition to your use of the Site, you represent and warrant that you will use the Site in compliance with these Terms of Use and all applicable laws and regulations. In addition, all posted advertisements on this Site must be of a nature to buy and sell items and services directly relating to the categories listed within this web site, related items and services.The E.R.C.S.A. Edmonton Remote Control Sailing Association reserves the right to monitor and/or remove ads at its discretion.
1.The ads service is for personal use only, commercial ads are not accepted.
2. Adverts must be clear in details and price. The promotion of ebay or similar auctions is prohibited as they do not comply with this requirement. Similarly, adverts for other classified ads services will not be accepted.
3. The E.R.C.S.A. retains the right to remove ads without notice, and to refuse or cancel users registration at any time.
4. Your details will not be passed on to any third party, except that we will pass on registration details at the request of a properly authorised law enforcement agency.
5. You warrant and affirm that your ads will be honest, decent, truthful and accurate.
6. Anonymous ads are not welcome: you must put some identifiable name as your username. Anonymous users will be suspended until this is done.
7. Ads must be limited to modelling related items. Adverts for unsuitable items will be deleted without notice. Decisions on what constitutes acceptable remain entirely with the E.R.C.S.A.
Ads that are not permitted include, but are not limited to, ads that contain the following content:
Racism, Hatred, Harassment, Defamation, Adult Content, Obscene Material, Nudity or Pornography, Piracy, Hacking, or Warez, Any Illegal Content
This service is for Universal users: we reserve the right to refuse or cancel registrations from overseas sellers. If you do purchase goods from outside the Province of Alberta, it is your responsibility to ensure that you pay the correct duty and taxes.
Disclaimer of Warranties
Your use of the site is at your sole risk. the site is provided to you on an "as is" and "as available" basis. The BMFA expressly disclaims any and all warranties of every kind, whether express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The E.R.C.S.A. makes no warranty that

(b) the site will be uninterrupted, timely, secure, or error-free,
(c) your use of the site will achieve any particular result,

(e) any errors in our software will be corrected.
Any material, product, or service obtained through the use of the site (including, without limitation, any third party resources and third party items) is done at your own discretion and risk and you will be solely responsible for any loss of data and damage to your computer system and any other property item that results from any such activity. No advice or information, whether oral or written, obtained by you from E.R.C.S.A. or through or from the site shall create any warranty not expressly stated in these terms of use. the disclaimers contained in this paragraph are a material part of our agreement to provide the site to you.
Limitations of Liability
The BMFA will not and shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages), resulting from:
(a) any use or inability to use the site;
(b) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the site;
(c) unauthorized access to or alteration of your transmissions or data;
(d) statements or conduct of any third party on the site; or
(e) any other matter relating to the site or any third party resources, third party materials, or third party businesses. the limitations of liability contained in this paragraph are a material part of our agreement to provide the site to you.
